Since May 2021, most BC car accident claims fall under ICBC Enhanced Care, which replaces lawsuits with defined benefits. You can still sue in limited situations, including when the at-fault driver is convicted of certain Criminal Code driving offences, or where a vehicle or road defect caused the crash.
